Confidentiality in the Treatment of Substance Use Disorders 

In 2014, 20.2 million adults in the U.S. were reported to have a substance use disorder (National Institute of Mental Health, 2016). The Health Insurance Portability Act and Accountability Act (HIPAA) and 42 CFR Part 2 both provide regulatory information on the privacy and security of a person’s health information in substance use treatment. As a healthcare professional, it is essential for you to understand the federal laws and regulations governing the privacy of healthcare information in general and substance use treatment information specifically. These 2 legal frameworks sometimes overlap and conflict. The legal protections regarding substance use disorder treatment information, in many instances, go beyond the protections provided under HIPAA. This course will provide information on HIPAA and 42 CFR Part 2 related to permissible disclosures of information specific to individuals seeking treatment for a substance use disorder and challenges for sharing information in an integrated healthcare setting.

Amanda Richards, MA, LPCC, LADC, MAC brings over 30 years’ experience as a counselor, creative arts therapist, educator, and trainer in the treatment of substance use disorders and co-occurring mental health challenges with adolescents, adults, and seniors in prevention, assessment, treatment, and continuing care. She is also Community Faculty in the Alcohol and Drug Counseling Program at Metropolitan State University, St. Paul, Minnesota where she teaches about professional ethics and confidentiality in addition to other counseling-related subjects. Before moving into consulting, Amanda served at the director level for mental health and substance use disorder programs, where she developed policies and procedures, trained volunteers and professional staff, and served as the Compliance Officer for HIPAA; 42 CFR, Part 2; and other regulatory and accreditation-related requirements. Amanda is a member of NAADAC, the Minnesota Association for Addiction Professionals, the American Counseling Association, Minnesota Counseling Association (Ethics chair), and is on the Board of Rainbow Health Initiative.
